This Lease Agreement for Parking/Container Space (“Agreement”) is made this day

between JWB PROPERTY MANAGEMENT, INC., an Illinois corporation, doing business at: 22419 W. Renwick Rd., Plainfield, Il 60544, (“Landowner”) and

(name of business entity/individual) with a business address and phone number as follows:

NOW, THEREFORE for good and valuable consideration stated herein, the sufficiency of which is hereby acknowledged, the parties agree as follows: 1. (Tenant) agrees to lease parking space for the purpose of storing commercial vehicles, trailers, chassis, and/or containers. These spaces are not to be used to store any personal items including but not limited to tires, tarps, or debris of any kind. These spaces are to be used to park the above or your drivers’ vehicles only. If the Landowner, asks Tenant to clean/clear space and such does not occur, fees will apply. A charge of $25.00 per tire, or $25.00 for entire space cleaned by Landowner for any such disposal. Fee will be added to monthly lease payment and debited the 1st of the following month of occurrence. Tenants are allowed to use dumpsters to throw away debris “from the road”. These dumpsters are not to be utilized for large debris, oils, or hazmat materials of any kind. No debris should be brought from personal residences to be disposed of in stated dumpsters. The storage of hazardous materials is strictly prohibited. Tenant, employees, or invites of Tenant agree to a strict 10mph/No Dust speed limit on all the property.

2. PARKING SPACES. Landowner agrees to Lease to Tenant, and Tenant agrees to lease from Landowner the following spaces @ $200.00 each monthly.

(number of parking spaces for bobtail) @ $150.00 each monthly

(number of spaces for storage units) @ $175.00 each monthly.

3. TERM. The term of this lease shall run month to month beginning __________. Tenant agrees to give notice to Landowner of termination of lease by the 15th of the month prior to moving out. The Landowner reserves the right to terminate lease with Tenant effective immediately for any abuse of lease agreement/terms.

4. RENT. Tenant agrees to pay Landowner total rent for the term described above in the amount of $__________. The rental payment shall be prepaid on the 1st day of every month. Payment will be deducted via draft from Tenants credit card/bank account on file with Landowner on the 1st day of every month.

5. LATE PAYMENTS. Any payments not received by the due date are considered delinquent and a late fee shall be assessed at a rate of $20.00 per day starting on the 5th day of the month.

6. REMEDIES, SURRENDER, AND USE. During or after default hereunder, Landowner may pursue any remedies available by law, including termination of tenancy. Tenant shall surrender the premises upon termination of lease. Tenant shall not use the space for anything other than what the space is designed for, or that is within all legal regulations, laws, and requirements.

7. ASSIGNMENT, ALTERATIONS, AND PROVISIONS. This agreement shall not be assigned and/or subleased to any third party or entity. Tenant shall not make any additions, alteration, and/or improvements to the premises. In the event it is necessary for Landowner to employ an attorney to enforce any terms of this agreement. Tenant agrees to pay any responsible attorney fees and court costs as provided by law: in the event of a trial, the amount shall be fixed by the court. Should any provision of this agreement be found to be invalid or contrary to any local, state, or federal law, the provision shall be considered null and void, and it shall not affect the validity of any other provision in this agreement.

8. LIABILITY. The Driver/Licensee, employees, or invitees of Tenant, and the Driver/Licensee, shall hold Landowner harmless from any and all actions and liability, and shall indemnify Landowners against any and all claims, actions, proceedings, damages, and liabilities including all attorneys’ fees, by Tenant, the Driver/Licensees possession and/or use of the rental space and premises. All risks and all losses are the sole responsibility of the Tenant and the Driver/Licensee. Tenant and the Driver/Licensee assume all the risks from parking on the premises. All losses of any kind (theft, vandalism, damage, acts of terrorism, acts of nature, weather, floods, or any loss of any kind) are the sole responsibility of Tenant and/or the Driver/Licensee. Tenant and the Driver/Licensee shall indemnify and hold harmless Landowner (Licensor), its officers, officials, affiliates, employees, shareholders, and volunteers from and against any and all claims, suits, actions, or liabilities for injury or death of any person, or for loss or damage to property, which arises out of Tenants and or Drivers/Licensees use of premises, or from the conduct of tenant and/or Driver/Licensees business, actions, vehicles, or from any activity permitted, or suffered by, any of the Driver/Licensees.

9. PROPERTY DAMAGE. Tenant is responsible for any and all damage to the premises (including but not limited to buildings, gates, fences, barriers, and/or cones) caused by any of its Drivers, Licensees, Employees, and or invitees.

10. GOVERNING LAW. This agreement shall be governed under the laws of the State of Illinois.

11. ENTIRE AGREEMENT. This agreement, together with any written and signed addenda hereto, constitutes the entire agreement between the parties. This agreement shall be binding upon the parties and their heirs, administrators, executors, successors, and assigns.
